1. Introduction

WEARBY is a curated online marketplace that enables verified individuals (“Sellers”) to list and sell personal items directly to buyers (“Buyers”). By accessing or using the platform, you acknowledge that you have read and agree to these Terms & Conditions.

2. Role of the Platform

WEARBY operates solely as an intermediary marketplace. WEARBY does not own, store or take physical possession of any listed items, and is not the buyer or seller of any product. Each Seller is solely responsible for their listings, authenticity, pricing, and fulfillment.

3. Eligibility

Users must have the legal capacity to enter into binding agreements and provide accurate information. Buyers may access the platform from any country. Sellers must reside in a country supported by Stripe Connect to receive payouts. WEARBY reserves the right to approve or reject accounts at its discretion.

4. Seller Verification & Approval

All Sellers undergo manual verification, which may include identity confirmation, review of public social profiles, and submission of verification photos. WEARBY may reject applications or remove listings that do not meet platform standards.

5. Listings & Authenticity

Sellers may only list genuine personal items they have personally owned. Each listing must include clear photos of the item, a photo of the Seller wearing or holding the item for authenticity verification, the item size, and a brief accurate description. Listings are subject to review before approval.

6. Pricing

Sellers determine their own pricing. WEARBY reserves the right to remove listings that are misleading or fraudulent.

7. Payments & Commission

7.1 Commission: WEARBY charges a 15% commission per completed sale. There are no upfront listing fees.

7.2 VAT & Tax Treatment: If the Seller is located within the European Union, the 15% commission may be subject to applicable VAT depending on the Sellers country of residence If the Seller is located outside the European Union, EU VAT is not applied. Sellers are responsible for their own tax obligations.

7.3 Payouts: Payments are processed via Stripe Connect. Payouts are released once the item is sold, confirmed, and delivered.

8. Shipping

Sellers are responsible for dispatching items. The platform provides an integrated shipping solution and generates the shipping label. Shipping costs are paid by the Buyer at checkout. WEARBY is not responsible for delays, customs issues, or service failures caused by third-party carriers.

9. No Return Policy

All sales are final. Items are personal, one-of-one pieces. Returns are not accepted unless the item is significantly misrepresented. WEARBY may review and mediate disputes at its discretion.

10. Buyer Responsibilities

Buyers must review listing details carefully, provide accurate shipping information, and complete transactions within the platform.

11. Prohibited Content

Sellers may not list items that are illegal, fraudulent, or violate applicable laws. WEARBY reserves the right to remove any listen that does not meet platform standards.

12. Limitation of Liability

WEARBY facilitates transactions between independent parties and is not responsible for disputes regarding item condition, shipping delays, or losses caused by third-party providers.

13. Account Suspension

WEARBY may suspend or terminate accounts that violate these Terms or attempt to bypass platform fees.

14. Modifications

WEARBY reserves the right to update these Terms at any time. Continued use of the platform following updates constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Spain.
